Your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in your country.
THE TYPES OF INFORMATION WE COLLECT
Personal Information You Provide to Us - We may collect Personal Information that you submit to us voluntarily through your access and/or use of the Service, including your user name, password, billing name and address, contact information such as phone numbers or e-mail addresses, and credit card information. We also retain information on your behalf, such as preferences that you store using your Account. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply, and any information that you submit to us. When you participate in one of our surveys, we may collect additional profile information. We may also collect Personal Information at other points in our Website that state that Personal Information is being collected. If you provide us information over phone or fax, we may add that information to the information we have collected.
HOW WE USE YOUR INFORMATION
In general, we use your Personal Information to respond to your requests as submitted through the Services and for Vendor Partners to charge your credit card the cost and transaction fee associated with the Products you order. In addition, we may use your Personal Information to determine your purchase preferences, to better understand how the Websites, Application and other Services are used; and to send you administrative e-mail or SMS text notifications.
We will share your Personal Information with third parties (including our Vendor Partners and their payment processing services providers) to fulfill your requests for Products, and we may share your Personal Information with third parties who perform services for us or on our behalf (including our payment processor or our service providers who provide support for the Services). These third parties are required not to use your Personal Information other than to provide the services requested by OpenTable. You expressly consent to the sharing of your Personal Information with these third parties.
We may create Anonymous Information records from Personal Information by excluding information (such as your name) that makes the information personally identifiable to you. We may use this Anonymous Information to analyze request patterns, usage patterns and other statistical data so that we may enhance our Services, including our Website and Application. OpenTable reserves the right to use and disclose Anonymous Information to third parties in its discretion.
We may disclose your Personal Information if we believe in good faith that such disclosure is necessary (a) to comply with relevant laws, rules or regulations or to respond to subpoenas or warrants served on OpenTable; or (b) to protect and defend the rights or property of OpenTable or users of our Services.
CHANGES TO PERSONAL INFORMATION
You may change your payment information by editing your Account through the Application. You may change any of your other Personal Information in your Account by editing your Account profile through the Website. You may request deletion of your Personal Information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.
HOW WE PROTECT YOUR INFORMATION
We use reasonable measures to maintain the security of your Personal Information. For example, we may require you to enter a password to access your Account. OpenTable does not directly store or manage your credit card number linked to your Account. The data is stored in a secure gateway by our or the applicable Vendor Partner's payment processing service provider. While OpenTable has numerous safety features built in to reduce the risk of unauthorized charges, OpenTable does not have direct control or responsibility for the credit card data.
Please be advised, however, that the Internet, mobile devices, and other various networking communication media are not entirely secure, and your information may therefore be subject to interception or loss which is beyond our control. Accordingly, OpenTable assumes no responsibility or liability for disclosure of your information (personally identifiable or otherwise) due to errors in transmission, unauthorized third party access or other causes beyond OpenTable's control.
